Sent: Thursday, April 16, 2009 4:37 PM Subject: Re: Complaint regarding FOI request Dear Mr Brooks, Your email of the 31st March 2009 has been passed to me as a request for a review of the Council's response to your request of the 24th February 2009 under the Freedom of Information Act 2000/ Environmental Information Regulations 2004. As you will be aware, the legislation applies to information held by a public authority. As indicated in Mr Howard's responses to you, the Council, despite a thorough search of the relevant records, does not hold any minutes or record of a meeting of the AQMA Steering Group on the 30th November 2007. Accordingly, it has complied with your request for copies of minutes of Steering Group meetings held in 2007 and 2008. As part of my review, I have asked Mr Howard to check his records and those of any other council officers who would have been likely to have attended if a meeting of the Steering Group taken place on the 30th November 2007. I have also asked him to check the booking records in respect of any room where the meeting might have taken place. Despite these inquiries, no record of such a meeting has been found. Notwithstanding that the legislation only requires the Council to provide information that it holds itself, Mr Howard has also contacted County Council officers who might have attended such a meeting, but again these inquiries have not produced any evidence that a meeting took place on that day. If you are still dissatisfied with this response, you may contact the Information Commissioner at Wycliffe House, Water Lane, Wilmslow SK9 5AF, telephone 08456 30 60 60, www.ico.gov.uk . I note that you refer in your email to a previous occasion when you did not receive attachments that you had requested. I had not been aware of that issue, but if you wish me to pursue it as a further review, perhaps you would let me have the relevant details. Yours sincerely, Sarah Taylor Head of Legal and Human Resources/Monitoring Officer Lancaster City Council Tel: 01524 582025 Fax: 01524 582030=20
