PPS23 3 November 2004 PPS23 is intended to complement the new pollution control framework under the Pollution Prevention and Control Act 1999 and the PPC Regulations 2000. This replaces Planning Policy Guidance Note 23: Planning and Pollution Control (PPG23) published in 1994. Note that all references in the text to the Office of the Deputy Prime Minister (ODPM). now refer to Communities and Local Government.

PPS23 - Annex 2: Development on Land Affected by contamination 3 November 2004 PPS23 - Annex 2: Development on Land Affected by contamination - This Annex provides advice to Regional Planning Bodies (RPBs), Local Planning Authorities (LPAs), developers and other interested parties on the issues relevant to development and use of land that may be affected by contamination and the extent of controls operated through planning and environmental legislation.

Please note: Appendix 2B of this Annex has been cancelled by the Department's letter of 30 May 2008 to Chief Planning Officers.

They replace Appendix 2B of Annex 2 of Planning Policy Statement 23: Planning and Pollution Control (PPS23) and paragraphs 56 to 59 of Appendix A of Circular 11/95: Use of conditions in planning permission which are cancelled.
